VIETNAM EXPLORERS TRAVEL TERMS AND CONDITIONS OF RESERVATION

Except as otherwise expressly agreed, Vietnam Explorers Travel Co. Ltd and its client/agent (or "Client/Agent") agree that the terms and conditions for the services rendered by Vietnam Explorers Travel to the Client, whether on an individual or a tour basis (or the "Services") shall be governed by the Terms and Conditions set out below and that the said Terms and Conditions shall form the service contract in its entirety, whether verbal or written, entered into between Vietnam Explorers Travel and the Client/Agent

Validity
All prices quoted to the Client/Agent are on a net basis and in United States Dollars and valid according to the date specified on the Vietnam Explorers Travel printed tariffs or quotation or invoice issued to the Client. Vietnam Explorers Travel warrants that the prices or rates quoted to the Client are correct at the time of issuance of the Client's quotation or invoice, but may be subject to change in line with market, tax or currency fluctuation, with or without prior notice.

Reservation and Confirmation
Reservations are to be made to our office. Upon confirmation of a reservation, US$150 non-refundable deposit per person is required, and the total package tour price for the Services should be paid at least 60 days (Sixty days) prior to client's arrival in Vietnam or starting date of the tour. Otherwise, Vietnam Explorers Travel at their sole discretion may cancel the bookings without any refund of sums already paid to Vietnam Explorers Travel by the Client. Vietnam Explorers Travel also reserves the right to change any arrangement (including tours, programs, prices and services) in the best interest of its Client with or without prior notice.

Payment
Deposit: upon confirmation of your booking, a non-refundable deposit is payable to Vietnam Explorers Travel within five working days.Receipt of the non-refundable deposit from you is deemed evidence that you have carefuly read and accepted our Terms Conditions

Balance of Payment: The balance for the journey must be paid to Vietnam Explorers Travel than 60 days prior to travle departure. If your booking is made less than 60 days prior to departure, you must provide full payment and complete booking details (including full insurance details) to us immediately. Your booking cannot be accepted or confirmed until we have received full payment and complete booking details from you.

Except as otherwise agreed by Vietnam Explorers Travel, Client's payment should be executed by cash, credit card. Except for cash payment, a service charge may apply. The Client is responsible for any bank charges relating to bank transfers. In cases where credit arrangements have been agreed to with the Client, payment shall be executed by swift or telegraphic transfer to the following bank accounts.

Cancellation, no show and early departure
Requests for cancellation of confirmed bookings must be made in writing and addressed to Vietnam Explorers Travel. In case of Special Train Journey and peak season hotel bookings, a separate cancellation policy is applicable (which would be advised as and when required). Cancellation charges would be effective from the date we receive advice in writing. Cancellation charges would apply as follows:

• Before arrival 60 days: no cancellation charge (US$ 100 non refundable deposit will be forfeited)
• From 31- 60 days before arrival: 10% tour cost after US$ 100 deposit
• From 16 - 30 days before arrival: 50% tour cost after US$ 100 deposit
• From 15 days to arrival or no show: 100 % tour cost

Refund
After commencement of travel, no refund in full or in part will be given for services included in the programme, which are not utilised.

Vouchers
Vouchers are to be issued by Vietnam Explorers Travel for all booking arrangements. A copy of the Client's itinerary should be enclosed with the voucher and should be received by the Client on his/her arrival or beginning of the arrangements booked.

Travel insurances
It is a condition of Vietnam Explorers that all travellers are adequately covered by travel insurance prior to arrival. Insurance should cover personal accident and medical expenses, evacuation and repatriation, baggage loss, and cancellation or curtailment of vacation. Your insurance details will be requested to supply to us at the time of booking.

Liability
Vietnam Explorers Travel shall, to the best of its capacity, provide the Services to the satisfaction of the Client. It is the understanding of the Parties that Vietnam Explorers Travel acts as an intermediary between the Client/Agent and airlines, hotels, transport operators, local tourist offices and other contractors providing the Services to the Client. Vietnam Explorers Travel shall in no event be liable to the Client/Agent, by reason of breach of Services or unsatisfactory Services provided to the Client by third parties or by way of indemnity or in tort or otherwise, for any loss, injury, damage, delay, change in schedule or other adverse events which are beyond the control of Vietnam Explorers Travel and/or sustained by an act or default of any person or company providing the Services to the Client. The Client/Agent warrants that Vietnam Explorers Travel shall not be responsible and/or liable for additional expenses and/or damages incurred due to any delay, accidents, natural disaster, political action or unrest.

Claims
All disputes, claims and litigation regarding the Services shall first be settled by way of negotiation and mutual understanding. In the event such negotiation and mutual understanding would fail, the disputes, claim or litigation shall be finally settled by arbitration of the Vietnam International Arbitration Centre (VIAC) at the Chamber of Commerce and Industry of the Socialist Republic of Vietnam. All claims must be submitted in writing within 30 days after the end of the Services.
